Litigation and PTO Practice
First and foremost, we are problem solvers with a full toolbox of intellectual property skills and talents. We have extensive experience in patent licensing and litigation, including all of the key jurisdictions such as the Eastern District of Texas, the District of Delaware, the Eastern District of Virginia, the Western District of Wisconsin, the Northern District of Illinois, the Southern District of New York, the Northern and Central Districts of California, the Federal Circuit Court of Appeals, and the United States Patent and Trademark Office. Our Patent Office experience spans the gamut of representation, from application filing and prosecution, including appeals, to post-grant work, including reexaminations and inter partes reviews (IPRs). We have also handled multi-district litigations involving trademark issues and internet advertising, unfair competition claims, joint venture disputes, and high stakes commercial disputes requiring more than just a superficial understanding of the technology involved. Our deep experience in seeking or defending against applications for injunctive relief is particularly useful in trade secrets cases, regardless of which side of the triangle we are retained to represent—the departing employees, the prior employer, or the new company. When appropriate, we have also worked in conjunction with state and federal prosecutors in parallel criminal investigations involving theft of trade secrets.
We structure and negotiate complex technology transactions, counseling our clients on the allocation of risk and leverage to help them achieve their business goals and foster business relationships. Our transactional experience includes licensing, outsourcing, development and distribution agreements, professional services, SaaS, data hosting, data licensing, open source assessments and mobile and online payment systems.
Data Security and Privacy
As privacy and data security is core to risk management for any company with sensitive business data, we design custom security and privacy programs for our clients to meet the compliance demands of their customers, regulators, business partners and employees. We advise on privacy and security by design, draft policies and contracts that bridge compliance gaps, align corporate processes and contracts to our clients’ risk management strategies, and develop employee training programs so that our client companies are using best in industry legal and administrative practices to protect their valuable business data.
